About this collection

Wilkes County Court Records includes documents from the Superior, Inferior and Ordinary Courts of Wilkes County, Georgia.  The records from this collection are from accession 1978-0528M, also known as the New Toomey collection.

 

The Superior Court, established in 1777, initially heard all civil and criminal cases.  After the establishment of the Inferior Court in 1789, the Superior Court continued to try all major criminal cases and civil cases involving more than fifty pounds sterling.  It was also the court for all cases involving equity and title to property.

 

The Inferior Court, established by the Judiciary Act of 1789, heard all common law cases.  If the amount of the case involved more than fifty pounds sterling, the defendant could remove the case to Superior Court for trial.  The Inferior Court also administered the county business.

 

The Court of Ordinary, also established in 1777, was the court of record for all estate and guardianship transactions.

 

This collection includes loose records from criminal cases, civil lawsuits, estate and guardianship transactions, and county business.  Records include petitions, subpoenas, warrants, affidavits, interrogatories, deeds, inventories and appraisements, accounts, receipts, vouchers, annual returns, promissory notes, fi fas, wills, civil (performance) bonds, criminal bonds, and divisions of property.  It also includes records of the Inferior Court sitting for county purposes for Wilkes County, and a small selection of records for the town of Washington, the county seat of Wilkes County.

 

The papers in this collection do not constitute the case file or the papers for an entire legal transaction or court case, whether a lawsuit, criminal proceeding, or the settling of an estate.  Please consult the Wilkes County record books for the official records of the courts.
